SATTERLEY BUY WITH CONFIDENCE OFFER TERMS & CONDITIONS (15.05.2020)

The following terms and conditions apply to the Satterley the ‘Buy with Confidence’ Campaign at Botanical, Habitat and True North estates (Promotion).

Promoter

The Promoter is Satterley Mickleham Pty Ltd ACN 612 101 550 in respect of Botanical, Tarneit Land Company Pty Ltd ACN 147 657 609 in respect of Habitat, and Satterley Greenvale Pty Ltd ACN 607 261 647 in respect of True North, all of Level 10, 5 Queens Road, Melbourne VIC 3004.

Participating Estates

Botanical of 2090 Mickleham Road, Mickleham (Botanical), Habitat of Corner Sayers and Davis Road, Tarneit (Habitat), and True North of Corner Aikten Boulevard and Silvester Parade, Roxburgh Park (True North).

Terms and Conditions of Promotion

The Purchaser acknowledges their consent to providing their personal information to the Promoter and agrees to and accepts these Promotion terms and conditions.   

Promotion Lots

The lots of land subject to the Promotion are lots – Botanical (278, 279, 503, 529, 618, 645, 655, 656, 682, 683, 685, 687, 689, 691, 901, 914, 925, 928, 954,  957, 960, 969, 973).  Habitat (1531, 1720, 1813, 1818, 1825, 1827, 1902, 1905, 1907, 1912, 1915, 1922, 1923, 1924). True North (1402, 1421, 1434, 1435, 1450, 1521, 1530) - sold during the Promotion Period at Participating Estates (Promotion Lots). 

Who does the promotion apply to?

The Promotion applies to any Purchaser who:

  • is a natural person;
  • is a resident of Australia;
  • is 18 years of age and over;
  • during the Promotion Period has paid a deposit prior to entry into a contract of sale at a Participating Estate for a Promotion Lot; and
  • has entered into a binding contract of sale of land between the Purchaser as the purchaser and the Promoter for the relevant Participating Estate as the vendor, for the purchase of a Promotion Lot (Contract of Sale) at a Participating Estate.

Promotion dates

The Promotion applies to Contracts of Sale entered into from 9 am AEST on Saturday 16 May 2020 and 5 pm AEST on Sunday 28 June 2020 (Promotion Period). The Promoter, may at its discretion, extend the Promotion Period by publishing a notice at the Sales Office with the dates of the extended promotion period. These terms and conditions apply to any extended promotion period.

Promotion offer

Subject to these terms and conditions, the Promoter is offering to eligible Purchasers that the Promoter will provide the Purchaser a contribution towards the Purchaser’s mortgage payment in the event the Purchaser becomes Unemployed within12 months from the settlement date.

If the Purchaser:

  • obtains a loan to settle the Promotion Lot and grants a mortgage to the financier over the title to the Promotion Lot as security for the repayment of this loan (Mortgage); and
  • is made Unemployed by its Principal Employer at any time during the Guarantee Period and gives written notice to the relevant vendor with evidence satisfactory to the vendor that the Purchaser is Unemployed at the date of the notice (Unemployment Notice),the relevant vendor agrees that it will pay the Mortgage Interest Amount to the Purchaser within 28 days of receipt of the Unemployment Notice.

Definitions

In these terms:

Guarantee Period means the period commencing on the settlement date (as defined in the Contract of Sale) and expiring on the date which is 12 months after the settlement date.

Mortgage Interest Amount means a lump sum amount equivalent to the interest payable on a loan for 90% of the Price at an interest rate of 3.25% per annum (which, for the avoidance of doubt, excludes any payment of the principal amount of the loan) from the date that the vendor receives the Unemployment Notice to the expiry of the Guarantee Period.

Price the purchase price payable by the Purchaser under the Contract of Sale, inclusive of any applicable rebates.

Principal Employer means the employer that the Purchaser is employed by and from whom the Purchaser derives the majority of their total gross income in exchange for the performance of work.

Unemployed means the termination of the Purchaser’s employment resulting in the Purchaser not performing any work under an existing employment relationship and not receiving any remuneration from the Principal Employer. For the avoidance of doubt, the Purchaser is not Unemployed if they have been stood down under the Fair Work Act 2009 (Cth), a contract of employment or any industrial instrument or if the Purchaser has ended the employment relationship.

Other Terms and Conditions

  • The Purchaser should refer to the special conditions in the Contract of Sale.
  • Where there is more than one Purchaser, the rights described in the Promotion offer only apply if all of the Purchasers are made Unemployed by their Principal Employer.
  • The Purchaser forfeits all their rights if:
  1. they fail to settle on the settlement date specified in their Contract of Sale;
  2. these terms and conditions are not satisfied for any reason whatsoever; or
  • the Purchaser breaches any term of their Contract of Sale.
  • This Promotion cannot be used in conjunction with any other campaign, offer or promotion promoted by the Promoter.
  • The Purchaser acknowledges and agrees that the Promoter shall not be liable to the Purchaser for any financial or legal implications (or otherwise) that may arise from the Promotion.
  • The Promotion does not constitute financial advice. Independent financial, legal or other professional advice should be sought by the Purchaser.
  • The Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion if for any reason the Promoter’s circumstances change or the Promotion is not available.
  • The Promoter reserves the right but not the obligation to substitute the Promotion for another similar item, of equal value.
  • To the extent permitted by law, under no circumstances will the Promoter be liable to the Purchaser for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Purchaser’s participation in this Promotion, even if the Promoter has been advised of the possibility of such damages.
  • There is no limit to the number of Contracts of Sale for Promotion Lots that a Purchaser may enter into under this Promotion.
  • These terms and conditions are governed by the laws of the state of Victoria.
