Satterley Botanical Display Village 'Pick of the Harvest' Event Competition

Terms and conditions of entry

  1. Information on how to enter this competition and prize details form part of these terms and conditions of entry (Terms).
  2. Entry is open to residents of Victoria who are over 18 years of age.
  3. Entry is limited to one per person.
  4. Employees, management and contractors of Satterley Property Group Pty Ltd (ABN 38 009 054 979) (the Promoter), its related bodies corporate and their suppliers and agencies involved in this competition are not eligible to enter this competition, nor are their immediate families.
  5. By participating in this competition, entrants acknowledge that they have read and understood these Terms and agree to be bound by them. Entries must comply with these Terms to be valid.
  6. The registration period for the competition commences on Saturday 29th February 2020 at 4.00pm Australian Eastern Standard Time (AEST) and will conclude on Saturday 29th February 2020 at 7.00pm AEST (Registration Period).
  7. To be eligible to enter the competition, entrants must attend the Display Village Launch Event, correctly complete the Competition Map and place the completed Competition Map into the entry barrel before 7.00pm.
  8. To enter the competition:
    1. entrants who have registered in accordance with clause 7 must attend the Launch Event, collect a Competition Map, complete the Competition Map and place that ticket in the draw barrel before 7.00pm; and
  9. If an entrant's contact details change prior to the draw taking place, it is the entrant's responsibility to notify the Promoter in writing.
  10. All entries become the property of the Promoter.
  11. The winner will be drawn randomly from the barrel in which the Competition Maps have been placed.
  12. The prize draw will take place on Monday 2nd March 2020 at 9.00am AEST at Satterley head office Level 10, 5 Queens Road, Melbourne VIC 3004.
  13. The first valid entry drawn will win a pre-paid VISA gift card to the value of AUD $5,000.00 (inclusive of GST) (Prize).
  14. The Prize will be provided to the winner within 28 days after the draw.

Prize conditions

  1. The Applicant will be contacted using the nominated details on the Competition Map to collect the Pre-Paid Visa Card from the Satterley Victoria office located at Level 10, 5 Queens Road, Melbourne VIC 3004. Satterley will make the Pre-Paid Visa Card available for collection within 28 days from the prize draw. Identification will be required and must match name of the purchaser as set out on the Competition Map. The Promotion is not transferable or exchangeable and cannot be taken as cash.

  2. The Applicant acknowledges and agrees that the Promoter shall not be liable to the Applicant for:

    1. late, lost, misdirected, incomplete or incorrect Special Condition Rebate Forms;
    2. any financial or legal implications (or otherwise) that may arise from the Promotion; or
    3. replacing any lost, stolen or damaged Pre-Paid Visa Cards.
    4. Independent financial, legal or other professional advice should be sought by the Applicant.
  3. The winner will be notified in writing following the prize draw. 
  4. Any queries regarding the activation, use, operation or any other query in relation to the Pre-Paid Visa Card must be referred to the card issuer.
  5. If the entrant selected as a winner is disqualified, not readily identified, un-contactable or unable to accept the Prize for any reason, a second chance draw will be conducted at Level 10, 5 Queens Road, Melbourne 3004, subject to any written directions given by any relevant regulatory authority. The winner of the second chance draw will be notified by email within 48 hours of the prize draw. 
  6. The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize, or any element of it, as stated. The Promoter reserves the right to substitute the Prize in whole or in part for something of equal or greater value if any component of the Prize is unavailable (subject to any applicable legislation). The Prize is not transferable, deferrable, exchangeable or redeemable for cash or product. The Prize cannot be sold to any other person (including by online auction or private sale). Unused portions of the Prize will be forfeited and no compensation will be payable in lieu of that element of the Prize.
  7. The Promoter accepts no responsibility for any tax implications that may arise from acceptance by a winner of the Prize. Entrants should seek their own independent financial advice.
  8. Winners accept the Prize at their own risk. None of the Promoter, its related entities or any of their employees, contractors and agents (or employees of their contractors and agents) will be liable for any liability, loss, damage or expense (including but not limited to direct, indirect or consequential loss or loss of profits), or death or personal injury, suffered or incurred (whether or not arising from any person's negligence) arising out of, or in connection with, this competition, the provision of the Prize, use or participation in the Prize or marketing of this competition, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  9. Incomplete, illegible, indecipherable and late applications are invalid. The Promoter accepts no responsibility for late entries or entries not received for any reason.
  10. The Promoter reserves the right to disqualify any entries in its absolute discretion. For example, the Promoter may disqualify: (a) any entrants or entries that tamper with, or attempt to tamper with the entry process; (b) incomplete, indecipherable or illegible entries or entries containing false information or incorrect contact details; (c) any entries that contain material that is obscene, indecent, objectionable, defamatory, libellous or otherwise contravenes an applicable law or infringes any third party's rights; and (d) any entries that the Promoter considers inappropriate for any reason.
  11. The Promoter reserves the right, at any time, to verify the validity of entries and the details provided by entrants (including without limitation an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. The information necessary for verification is at the sole discretion of the Promoter.
  12. All entrants who are selected as winners agree to take part in publicity for this competition as reasonably requested by the Promoter, and agree to the Promoter using their name, image, likeness, character, voice or anything else that identifies them in any media worldwide (including without limitation in national print media, on the Promoter's website and in other promotional material) for a reasonable time without remuneration to promote any of the Promotion, the Promoter and any of the Promoter's products or services.
  13. Privacy Statement. The personal information of individuals who register to attend the Display Village Launch Event (including entrants) is collected by the Promoter, and may be disclosed to the Promoter's contractors and agents (including without limitation marketing and promotional agencies, information technology providers and database service providers) and related bodies corporate to conduct, administer and publicise this competition and to send the individual information about the Promoter's products and services (unless the individual opted out of receiving this information at the time of registration). Individuals can advise the Promoter at any time if they do not wish to receive this information. Otherwise, their consent will remain current until specifically withdrawn.  Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under relevant lottery legislation.  Individuals who do not provide the personal information requested on the registration form will not be able enter the competition. If inaccurate or incomplete personal information is provided, the Promoter may determine that the entrant is ineligible to win the Prize. The personal information collected by the Promoter is not likely to be disclosed to overseas recipients.   14. Each entrant must comply with these Terms. Each entrant indemnifies and will keep indemnified the Promoter in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by the Promoter as a direct or indirect result of the entrant acting inconsistently with or breaching any part of these Terms.
  15. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination of these, or any other technical failures related to, or resulting from, participation in this Promotion.
  16. If for any reason this competition is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any applicable legislation.
  17. The Promoter's decision on all aspects relating to this competition is final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
